Form SSA-561: appeal a Social Security overpayment within 60 days
Disagree with the overpayment amount? Ask for reconsideration with Form SSA-561 within 60 days of the notice.
When to appeal
Appeal if you think Social Security made a mistake in the amount, or if you were not overpaid.
The deadline
Submit your request for reconsideration within 60 days of the decision. Send it within 30 days to stop collection until Social Security decides.
The form
Request for Reconsideration, Form SSA-561-U2. Reconsideration is the first of four appeal levels: reconsideration, a hearing with an administrative law judge, the Appeals Council, and federal court.
